Below is a copy of the complaint filed last week by the husband and child of Marion Hedges, who was injured on October 30, 2011 when struck by a shopping cart dropped from an elevated walkway of a Harlem shopping center (news regarding the recent sentencing of one of the teens involved in the incident here).
Plaintiffs contend that Ms. Hedges’ injuries were caused by defendants’
“carelessness, recklessness and negligence … in failing to properly maintain a safe and secure environment, in failing to properly maintain safe and secure elevated walkways, in failing to render proper security measures and plans to protect patrons of said plaza, in failing to properly provide proper security for said plaza, [and] in failing to promptly respond to prior complaints of items being thrown off the elevated walkways…”
