Below is the New York state court complaint, captioned Lindsay Lohan and Dina Lohan v. Fox News Network, LLC et al. (NY Sup. Ct. Index No. 150973/2015) filed on February 2, 2015 by Lindsay Lohan and her mom Dina Lohan, against (among others) Fox News Network, Michelle Fields, and Sean Hannity.
Plaintiffs allege, among other things, that during a February 4, 2014 broadcast on Sean Hannity’s show concerning “recent deceased celebrities and drug use, including … Philip Seymour Hoffman,” guest commentator Michelle Fields
falsely inappropriately and shockingly stated, unequivocally, and as a “matter of fact” that “Lindsay Lohan’s mom [Dina Lohan] is doing cocaine with her[.]
It is alleged that this “false defamatory comment … was a direct smear on the character/reputation of” the Lohan plaintiffs.
Commentators are already predicting that plaintiffs will lose, for at least the reason that the Lohan plaintiffs (being “public figures”) must meet the high standard of establishing that defendants acted with “actual malice” when making the alleged defamatory statement. In any event, let the Streisand effect commence!
