Sexual Orientation Discrimination

While federal law does not prohibit discrimination on the basis of sexual orientation, such discrimination is prohibited under the New York State Human Rights Law and the New York City Human Rights Law.

Such discrimination can take many forms, including:

  • Making explicit negative remarks regarding one’s sexual orientation or gays and/or lesbians generally;

  • Sending offensive emails or leaving offensive pictures on one’s desk; or
  • Being assigned less desirable tasks or being paid less because of one’s sexual orientation.

Discrimination and retaliation are often not explicit, however, and seemingly innocuous conduct may hide an underlying discriminatory purpose.
