Starting September 6, 2018, all New York City employers will be required to display an anti-sexual harassment rights and responsibilities poster and develop a sexual harassment information sheet to be distributed to individual employees at the time of their hire. This amendment, which is part of the Stop Sexual Harassment in NYC Act, will be codified at N.Y.C. Administrative Code 8-107(29).
According to the CCHR’s website, this document satisfies the poster requirement, and this document satisfies the information/fact sheet requirement.
The fact sheet clarifies that “[s]exual harassment, a form of gender-based discrimination, is unwelcome verbal or physical behavior based on a person’s gender.” It gives the following examples of sexual harassment:
- unwelcome or inappropriate touching of employees or customers
- threatening or engaging in adverse action after someone refuses a sexual advance
- making lewd or sexual comments about an individual’s appearance, body, or style of dress
- conditioning promotions or other opportunities on sexual favors
- displaying pornographic images, cartoons, or graffiti on computers, emails, cell phones, bulletin boards, etc.making sexist remarks or derogatory comments based on gender
It also explains that the law prohibits employers taking action, or retaliating, against employees because they oppose or speak out against sexual harassment.
